These Terms of Use (“Terms”) govern your use of the Give Barakah website and the hosted masjid donation pages and services we provide (together, the “Service”). Give Barakah (“we”, “us”, “our”) is registered in England and Wales; full company registration details are available on request. By using the Service you accept these Terms. If you do not accept them in full, please stop using the Service. These Terms include our Privacy Policy.
These Terms are for visitors and donors. If you administer a masjid account, a separate platform agreement governs that relationship. Where you give to a masjid, that masjid's own terms may also apply.
1. Your relationship with Give Barakah
We operate a Sharia-conscious donation platform that lets UK community masjids receive and manage donations. We provide the technology; the masjid you donate to is the recipient of your gift and is responsible for how it is used. “Content” means any text, images, links or other material you can view on, access through, or submit to the Service.
2. Who can use the Service
You must be at least 18 years old to make a donation or open an account. The Service is not directed at children under 13. You agree to provide accurate information and to keep any account credentials secure; you are responsible for activity under your account.
3. Acceptable use
You agree that you will not:
- use the Service for any unlawful, fraudulent or harmful purpose, or in a way that infringes others' rights or restricts their use of it;
- use the Service for money laundering, terrorist financing, sanctions evasion, or dealings with sanctioned persons or entities;
- misrepresent your identity or affiliation with any person or masjid;
- copy, distribute, sell or otherwise exploit the Service or its Content except as expressly permitted (for example, using our share buttons);
- alter, modify, reverse-engineer or interfere with any part of the Service;
- circumvent or disable any security feature, or introduce any virus, malware or other harmful code;
- use automated systems (such as bots or scrapers) beyond what a standard browser would request, except for public search-engine indexing; or
- harvest other users' personal data or any masjid's donor data, or send unsolicited communications.
4. Donations and payments
Donations are processed by our payment processor, Stripe, under Stripe's own terms. When you donate, you are giving to the masjid shown on the donation page, not to Give Barakah. You are responsible for selecting the correct donation type (such as Zakat, Sadaqah or Lillah) and for the accuracy of any Gift Aid declaration — you must be a UK taxpayer who has paid enough tax to cover the Gift Aid claimed. Donations are generally non-refundable, except for genuine errors or where the law requires. Any fees are shown at checkout.
5. Your content
You keep ownership of any Content you submit, and you are responsible for ensuring it is lawful and that you have the right to submit it. You must not submit Content that is offensive, hateful, defamatory, infringing or otherwise unlawful. By submitting Content you grant us and the relevant masjid a worldwide, non-exclusive, royalty-free licence to host and display it solely to operate the Service. We may remove Content we reasonably believe breaches these Terms.
6. Links and third-party services
The Service may link to, or rely on, third parties — including Stripe and our other service providers — which operate under their own terms. We are not responsible for third-party websites or content, and a link is not an endorsement. You use them at your own risk.
7. Intellectual property
The “Give Barakah” name, logo and brand are ours and may not be used without our written consent. Other names and logos shown on the Service — including those of masjids and partners — belong to their owners. The Service and its Content (excluding user and masjid Content) are owned by us or our licensors. You may view and download Content for your own personal, non-commercial use without altering it or removing any notices; any other use requires our consent.
8. Disclaimers and liability
The Service is provided “as is” and “as available”. To the extent permitted by law we do not warrant that it will be uninterrupted, secure or error-free. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be limited. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, goodwill, opportunity or data.
9. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms, where required by law, or if we stop providing the Service in your country. Provisions that should survive termination — including those on content licences, intellectual property, disclaimers, liability and governing law — continue to apply.
10. General
These Terms (with the Privacy and Cookie policies) are the entire agreement between you and us regarding the Service. If we do not enforce a right, that is not a waiver of it. If any provision is held invalid, the rest continues in force. A person who is not a party to these Terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999. These Terms are governed by the law of England and Wales and subject to the exclusive jurisdiction of its courts.
11. Changes to these Terms
We may update these Terms from time to time. The current version is always posted here with its date; significant changes will be highlighted. Continuing to use the Service after a change takes effect means you accept the updated Terms.
